These Terms & Conditions govern your use of the Maro Gifts website and the purchase of products from our online store. By accessing or using our website, you agree to be bound by these Terms.

- You agree not to misuse the website, interfere with security features, or engage in fraudulent activity.

- We aim to ensure all product descriptions, images, and pricing are accurate.
- Colours may vary slightly due to screen settings.
- All products are subject to availability.
5. Pricing & Payment
- All prices are listed in AUD and include GST where applicable.
- Payment must be made at checkout using approved payment methods.
- We reserve the right to change prices at any time before an order is placed.
6. Shipping & Delivery
- Shipping rates and delivery estimates are displayed at checkout.
- Once dispatched, delivery times are subject to courier conditions.
- We are not responsible for delays outside our control.
7. Returns, Refunds, Personalisation & Digital Products
7.1 Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).
You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure is not major.
7.2 Returns & Refunds
We accept returns, refunds, or replacements where:
- The product is faulty or damaged
- The product is not as described
- The incorrect item was supplied
Where a product is deemed faulty, damaged, or incorrect, we may request photographic evidence to assess the issue and determine the appropriate remedy in accordance with the ACL.
Due to the nature of our products, including personalised and made-to-order items,
change-of-mind returns are not accepted.
7.3 Custom & Personalised Items
Many of our products are custom-made or personalised, including (but not limited to) personalised candles, reed diffusers, coasters, wedding favours, corporate gifts, and QR-linked products.
By placing an order for a personalised item, you acknowledge and agree that:
- Personalised and custom-made items cannot be cancelled, refunded, or exchanged for change-of-mind.
- Customers are responsible for ensuring that all personalisation details (including spelling, names, dates, text, images, links, and QR destinations) are correct at the time of ordering.
- Errors resulting from customer-provided information are not eligible for refunds or replacements.
- If Maro Gifts makes an error in the personalisation or production of your order, we will, at our discretion, replace the item or provide a refund.
Once personalisation details, artwork, or proofs are approved, production will proceed and no further changes or cancellations can be made.
7.4 QR Codes, Digital Content & User-Generated Content
Some products offered by Maro Gifts include QR codes that link to customer-uploaded images, videos, or other digital content.
By purchasing or using these products, you agree that:
- You are solely responsible for any content you upload or submit.
- You confirm that you own, or have the legal right to use, all content uploaded.
- Uploaded content must not be illegal, offensive, defamatory, or infringe intellectual property or other rights.
- Maro Gifts does not monitor, verify, or endorse user-generated content.
- We reserve the right to remove or disable access to content that breaches these Terms or applicable laws, without notice.
- Maro Gifts is not liable for any loss, damage, or claims arising from user-generated content.
7.5 Digital Hosting & Access Limitations
- QR-linked digital content is hosted for a reasonable period unless otherwise stated at the time of purchase.
- Maro Gifts does not guarantee perpetual or lifetime access to digital content.
- Access may be limited, suspended, or discontinued due to technical issues, platform changes, security concerns, or business decisions.
- We are not responsible for loss of access caused by factors outside our control, including third-party hosting providers.
- Customers are encouraged to retain their own copies of all uploaded digital content.
7.6 Weddings, Events & Time-Sensitive Orders
- Customers are responsible for placing orders with sufficient time to allow for production and delivery.
- Production and dispatch timeframes are estimates only and are not guaranteed.
- Maro Gifts is not responsible for missed events, ceremonies, or deadlines due to:
○ Late orders
○ Courier delays
○ Incorrect delivery details
○ Circumstances beyond our reasonable control
We strongly recommend ordering well in advance for weddings, events, and special occasions.
7.7 Bulk, Corporate & Branded Orders
- Bulk or corporate orders may require longer production and delivery timeframes.
- Customers are responsible for reviewing and approving any proofs, mock-ups, or branding prior to production.
- Once approval is given, no changes or cancellations can be made.
- Maro Gifts is not responsible for errors that are approved by the customer at the proof stage.
- Custom corporate items are subject to availability and may vary slightly from samples or images shown.
8. Intellectual Property
All content on this website — including images, branding, text, and designs — is the property of Maro Gifts and may not be reproduced without permission.
9. Limitation of Liability
To the extent permitted by law, Maro Gifts is not liable for indirect, incidental, or consequential damages arising from the use of our website or products.
10. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
